The High Court dismissed Westpac’s appeal in the case Westpac Securities Administration Ltd v Australian Securities and Investments Commission [2021] HCA 3. The case, on appeal from the Full Federal Court, considered whether advice given to Westpac’s existing customers, as part of an outbound call campaign, which recommended that they roll over their superannuation into their Westpac-aligned superannuation fund, was personal advice.
This is a significant judgment, and one that confirms that meeting the personal advice test can be a low bar. This judgment will be particularly important for those financial services providers operating under a general advice model.
